72-year-old Joseph Carrick of Carysfort Woods, Blackrock, Co Dublin is bringing a Supreme Court appeal against the damages awards handed down by two High Court juries last year.
Carrick was ordered to pay €4m compensation to Jacqueline O'Toole for raping her in the early 1970s, and €700,000 to her cousin Geraldine Nolan who he also abused.
He did not defend either action for damages.
Ms Justice Elizabeth Dunne later rejected his claim that his inaction was a result of mental incapacity. She found it was more a sign of poor judgment.
However, today she ruled that the 72-year-old is not obliged to pay the women damages while his case is under appeal - partly because his assets have been frozen by order of the court.
Carrick is seeking an urgent Supreme Court hearing in which he will challenge the amount awarded to his victims and what he says was their delay in taking action against him.
