Lawyers for the baby boy claim the mother and child have been separated at a time when their bond should not be broken.
The mother has a teenage child who was taken into care arsing from allegations made against her partner, whom she has since married.
Yesterday her one-day-old son was also identified as being at risk and was taken into care following an emergency HSE application to the District Court.
Lawyers for the infant say the procedures adopted and the decision are flawed.
The baby's lawyers said earlier that day the mother left hospital and went to a friend's house which was then surrounded by gardai who entered and told the occupants they were under house arrest.
They're querying the procedures adopted in the case, in circumstances where the mother is prepared to live apart from her husband and where the baby is a 2-day-old breast-fed infant.
Mr Justice Sean Ryan has ordered an inquiry into the circumstances in which the care order was made - a hearing that may take place tomorrow, once the HSE is put on notice.
